TERMS OF SERVICE

1. Overview

Welcome to Avani. The terms "we", "us", and "our" refer to Avani ("Avani", "the Store"). Avani operates this store and website, including all related information, content, features, tools, products and services, in order to provide you, the customer, with a curated shopping experience (the "Services"). Avani is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service, together with our Refund Policy, Shipping Policy, and Privacy Policy (collectively, the "Terms"), describe your rights and responsibilities when you use the Services. By visiting, interacting with, or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you should not use or access our Services.

2. Access and Accounts

By agreeing to these Terms, you represent that you are at least 18 years old, or that you have your parent or guardian's permission to use the Services. To use certain features of the Services, you may be asked to provide information such as your name, email address, billing, payment, and shipping information. You represent and warrant that all information you provide is correct, current, and complete.

You are solely responsible for maintaining the security of your account credentials and for all activity on your account. You may not transfer, sell, assign, or license your account to any other person.

3. Our Products

We have made every effort to accurately represent our products, including the Avani Puré Pore Vacuum, Avani Ultrasonic Skin Scrubber, Avani Lumière LED Photon Therapy Mask, and Avani Complete Collection Bundle. Please note that colours or product appearance may differ from how they appear on your screen due to your device and display settings.

All product descriptions, pricing, and availability are subject to change at any time without notice, at our sole discretion. We reserve the right to discontinue any product or limit quantities offered to any person or region.

4. Orders

When you place an order, you are making an offer to purchase, which Avani may accept or decline at its discretion. Your order is not accepted until we confirm acceptance and process your payment. We reserve the right to correct any errors, inaccuracies, or omissions in pricing or product information, and to cancel orders affected by such errors, even after an order has been submitted.

Purchases are subject to return, refund, or exchange solely in accordance with our Refund Policy, which reflects your statutory rights under the CPA and ECT Act. You represent that your purchases are for personal use and not for commercial resale or export, unless otherwise agreed with us in writing.

5. Prices and Payment

All prices are listed in South African Rand (ZAR) and are subject to change without notice. The price charged will be the price in effect at the time your order is placed, as confirmed in your order confirmation email. Prices may or may not include VAT depending on our VAT registration status at the time of your order; this will be clearly reflected at checkout and on your invoice.

Payments are processed through our third-party payment gateway. You represent that any payment information you provide is accurate and that you are authorised to use the selected payment method.

6. Shipping and Delivery

Shipping and delivery are governed by our Shipping Policy. Avani currently ships within South Africa only. Estimated delivery times are provided in good faith but are not guaranteed, and in accordance with Section 46 of the ECT Act, delivery will occur within 30 days of purchase unless otherwise agreed.

7. Intellectual Property

Our Services, including all trademarks, text, images, graphics, product photography, and the design and arrangement thereof, are owned by Avani or its licensors and are protected by South African and international copyright, trademark, and other intellectual property laws.

These Terms permit you to use the Services for personal, non-commercial use only. You may not reproduce, distribute, modify, or create derivative works from any material on the Services without our prior written consent.

8. Optional Third-Party Tools

The Services may provide access to tools or links operated by third parties (such as our courier partner, Aramex, or our payment gateway) which we do not control. We provide access to such tools "as is" and without warranty, and accept no liability arising from your use of them. Please review the relevant third party's own terms before use.

9. Privacy and POPIA

All personal information we collect is handled in accordance with our Privacy Policy and the Protection of Personal Information Act 4 of 2013 (POPIA). By using the Services, you acknowledge that you have read and understood our Privacy Policy.

10. Prohibited Uses

You agree to use the Services only for lawful purposes. You may not use the Services to: violate any South African law or regulation; infringe our intellectual property or that of others; harass, abuse, or defame any person; transmit false or misleading information; upload viruses or malicious code; scrape, mine, or use automated tools (including AI agents) to access the Services without our permission; or attempt to bypass any security measure we employ. We reserve the right to suspend or terminate your account at any time if we determine you have violated these Terms.

11. Disclaimer of Warranties

The Services and all products offered through them are provided "as is" and "as available." Except as expressly stated in our Refund Policy or as required by the CPA, we do not warrant that the Services will be uninterrupted, timely, secure, or error-free. Nothing in this section limits any warranty or right that cannot lawfully be excluded under the CPA.

12. Limitation of Liability

To the fullest extent permitted by South African law, Avani, its directors, officers, employees, and agents shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Services or any product purchased through them, except where such liability cannot be excluded under the CPA or other applicable law.

13. Indemnification

You agree to indemnify and hold Avani harmless from any claims, damages, or liabilities, including reasonable legal costs, arising from your breach of these Terms, your violation of any law, or your misuse of the Services.

14. Changes to These Terms

We may update these Terms from time to time by posting the revised version on this page and updating the "Effective Date" above. Your continued use of the Services after changes are posted constitutes your acceptance of those changes.

15. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of South Africa. Any dispute arising from these Terms or your use of the Services shall be subject to the non-exclusive jurisdiction of the South African courts, without prejudice to your right to approach the Consumer Goods and Services Ombud (CGSO), the National Consumer Commission (NCC), or any other body with jurisdiction over consumer disputes.
